Before registering on, accessing, or using the Platform or any of its services, please carefully read these Terms of Use, the Privacy Policy, Clubs & Leagues Agreement, Frequently Asked Questions (FAQs), any Feature Terms and Promotion Terms (if applicable) and Community Rules (collectively, the “Platform Policies”).

Introduction & Acceptance
PokerBoss is an online social gaming platform operated by Zaptech Media Limited. For these Terms of Use, Zaptech shall mean and include Zaptech Media Limited, its partners, parent company(ies), subsidiaries, associates, licensees, licensors, and affiliates (collectively referred to herein as “Zaptech”, “PokerBoss”, “Platform”, “We”, “Us”, or “Our”).
These Terms of Use (“Terms”) in conjunction with other Platform Policies constitute a legal binding agreement between any person accessing the Platform (“You”, “Your”, “User”) and Zaptech, basis which You may visit, access or use the Platform through its website, mobile application, APIs, including any Games, content, features and services (“Services”). Accordingly, these Terms and other Platform Policies should have been read and understood by You prior to registering or accessing Our Services.
1. PokerBoss is a social, peer-to-peer, free to play online poker gaming platform/ application (“Platform”) purely for the purposes of entertainment and for providing Users with a virtual gameplay experience to enhance their poker skills while playing amongst friends and communities (through formats including Texas Hold’em and other poker variants as may be available on the Platform from time to time) using only in-app virtual items and chips, having no monetary or real-world value.
2. PokerBoss neither offers nor permits any form of online money gaming, placing of monetary stakes, betting, wagering, or gambling in any manner whatsoever. All the Services being offered by PokerBoss are strictly for the purposes of entertainment, recreation, skill-enhancement and social engagement. The Platform does not permit real-money gaming, cash prizes, real-world rewards, or withdrawals, exchange or redemption of any in-game virtual items or chips for money or any real-world value. Virtual chips/items are strictly for in-app gameplay, entertainment purposes and are intended for non-commercial use. They have no real-world value and cannot be withdrawn, transferred, redeemed, or exchanged for money or any item of real-world value.
3. By accessing or using the Platform (including the Platform website, mobile application, APIs or any Services offered by the Platform, directly or indirectly), or by creating an Account, You acknowledge that You have read, understood, accept, and agree to be bound by the Platform Policies. If You do not agree with these Terms or any other Platform Policy, please do not use the Platform in any manner.
4. We reserve the right to periodically review, update or otherwise modify any part of the Platform Policies at Our absolute and sole discretion. Unless stated otherwise, any revisions will take effect immediately upon being uploaded on the Platform. Please review the Platform Policies regularly to stay informed of any updates. We will provide You with notice of any material modifications to the Platform Policies. Your continued access or use of the Platform after any changes will constitute your deemed acceptance of the modified Platform Policies.
5. In case of any conflict or inconsistency between provisions of any of the following, the order of precedence in respect of such conflicting provision(s) is as follows: (i) Feature Terms/Promotion Terms (for a particular Game or Promotion), (ii) Clubs & Leagues Agreement, (iii) these Terms, (iv) Community Rules, (v) Privacy Policy.
Definitions
In these Terms, unless the context otherwise requires, the following terms shall have the below meaning:
1. “Account” means Your User profile/account created on the Platform using your valid, current and accurate information and details.
2. “Applicable Law(s)” means all applicable statutes, enactments, laws, ordinances, treaties, conventions, protocols, bye-laws, rules, regulations, guidelines, notifications, notices, policies, judgments, decrees, injunctions, writs or orders, instructions, decisions of any court/tribunal or other requirements or official directives of any governmental authority, in any jurisdiction, as may be applicable to the relevant person/User.
3. “Clubs” / “Leagues” refer to User-created Game groupings or sessions on the Platform.
4. “Community Rules” means the Platform-prescribed rules of conduct for interaction amongst Users on the Platform.
5. “Feature Terms” / “Promotion Terms” means any additional terms and conditions applicable to any specific Games, tournaments, Promotions, or features available on the Platform.
6. “Force Majeure Event” has the meaning prescribed to it in Clause W (Force Majeure) below.
7. “Game(s)” means any poker variant or table format (including formats such as Texas Hold’em, Omaha, etc.) as available on the Platform from time to time.
8. “In-app purchase” means the in-app purchases made via third-party app stores like Google Play Store & Apple App Store.
9. “User Content” has been defined in Clause L (User Content, Communication, and Feedback) below.
10. “Virtual Items” means and includes any in-app virtual currency (Virtual Chips), diamonds, avatars, cosmetics, tickets, goods, services or features offered only within the Platform. They do not have any real-world or monetary value and are neither equivalent nor can be converted, redeemed, withdrawn, transferred, exchanged, or encashed for money or any real-world value. They are strictly for in-app gameplay, entertainment purposes and non-commercial use within the Platform.
11. “Third-Party Content/Websites” refers to all third-party content, links, or services not controlled by, endorsed or related to Us.
Updates and Modifications
1. We reserve the right to update or modify these Terms and other Platform Policies at our sole discretion, from time to time, with or without notice and without liability to You or any third party for such actions. Unless stated otherwise, such revisions will take effect immediately upon being posted on the Platform.
2. Please review the Platform Policies regularly for any updates. For material changes in any Platform Policy, We may notify You via email, push messages, in-app messaging/notifications, or any other reasonable means. If You do not agree with any updated Platform Policy, You must immediately stop accessing the Platform and may request for Account deletion. Your continued access or use of the Platform after any modification(s) to the Platform Policies will constitute your deemed acceptance thereof.
3. The version of these Terms in effect when We receive actual notice of a Dispute governs that Dispute.
Eligibility & Age Requirements
By visiting, accessing or using the Services of the Platform, You agree and undertake that:
1. Age Requirement:
  1. You are at least 16 years or older (or a higher minimum age as applicable in Your country of residence). If not, You shall not access our Platform, use any of our Services, create an Account or submit any personal information to the Platform (such as your name, address or email address).
  2. The Platform and its Services are intended solely for individuals who meet this age requirement. We reserve the right to request proof of identity at any time to verify that individuals who fall below the minimum age threshold indicated above are not in any manner using the Platform and its Services. The Platform in its sole discretion may block access to any person if proof of identity is not provided to its satisfaction or it is suspected that the person accessing the Platform is such an underaged individual.
2. Jurisdictional Restrictions:
  1. You shall only access the Platform and its Services from such jurisdiction(s) where offering of the Platform and Your access of its Services is permitted as per Applicable Laws.
  2. The laws governing online gaming or any aspect thereof may vary across jurisdictions and are subject to change over time. Accordingly, it is Your responsibility to ensure that Your participation or access to the Platform complies with Applicable Laws at all times.
  3. You are strictly prohibited from attempting to access the Platform or any of its Services at any time from any jurisdiction where the provision of such Services is prohibited under any Applicable Law.
3. You are of sound mind and are competent to contract.
4. You have read, understood and agreed to these Terms and other Platform Policies and agreed to be bound by each of them.
5. You will comply with all Platform Policies, including any terms and rules governing the activities that You participate on the Platform, at all times.
6. You will remain in compliance of all Applicable Laws at all times.
7. Your registration or use of the Platform will not breach any Applicable Law or legal obligation to which you are subject.
8. You represent that You satisfy the eligibility requirements prescribed under these Terms and Applicable Laws and will remain in compliance thereof. You further represent that all information You provide to the Platform at any time is your own and is true, accurate, current and complete. You will promptly update such information to maintain its accuracy and completeness at all times and will promptly report of your subsequent ineligibility to access the Platform.
9. If, at any time, it is determined or reasonably suspected that You do not meet any of the eligibility criteria prescribed herein or elsewhere under these Terms or under Applicable Laws or have provided information that is false or incorrect, PokerBoss reserves the right to immediately suspend, restrict, or permanently block Your Account without prior notice and to revoke any associated access or Virtual Items. Any breach of this Clause constitutes a material breach of these Terms.
Access and usage of the Services
1. Membership to the Platform is strictly restricted to one User per Account. Users having more than one Account or multiple persons sharing or accessing a single Account is strictly prohibited.
2. Mere registration by a User on the Platform does not guarantee membership. The Platform shall accept or reject membership requests at its sole discretion.
3. Every guest login will create a new guest Account each time and be treated as a separate entry. Any associated gameplay progress will be lost upon closing a guest session. Accordingly, Users using the Platform through guest Account may link such Account to their valid email or Single Sign-On so that their gameplay progress is saved and their Accounts are recoverable. It is clarified that Accounts created through guest logins are also governed by these Terms and all other Platform Policies. By using a guest Account, You acknowledge and agree that the Platform will not be liable in any manner for any loss or claims arising from or in connection with Your guest Account.
4. Users, guest or otherwise, do hereby explicitly agree to indemnify and hold harmless the Platform for any loss regarding gameplay progress or otherwise as further provided under Clause U of these Terms.
5. You acknowledge and agree that You are solely responsible for Your own conduct while using the Platform. Your User Account and access to Our Services remains subject to Your continued compliance of the Platform Policies and of Applicable Laws.
6. The Platform reserves the right to suspend, terminate or block Your access to the Platform or any part thereof at any time for any reasons it deems fit, including without limitation, to protect the safety and integrity of the Platform and/or of its Users, violation of any Platform Policy or Applicable Laws.
7. You agree that We may, in our sole discretion, limit, suspend, terminate, modify, or delete Accounts or access to the Services or features or any part thereof, prohibit access to Our Games and websites/application, and their content, services, and tools, or delay or remove hosted content at any time and without prior notice, and We are not liable for any losses or results claimed on account thereof.
8. You may stop using our Services at any time and may request for Account deletion by following the instructions in Our Privacy Policy. We will process the same in accordance with the terms prescribed therein.
9. The server where the software is installed and the games hosted will be placed in a strictly confidential area where the access to the server is completely restricted both physically and virtually. Any person(s) or group that will be authorized to access the server where the Games are held are not allowed to register themselves as Users, thus, not allowed to become members. Such people are not allowed to use the software/play Games or use any other product or service provided by Zaptech.
10. Nothing contained in these Terms would be construed as a charge/subscription fee for being a User of the Platform.
11. You acknowledge that You access the Platform at Your own discretion and the Platform shall have no liability whatsoever for any loss, damage or claim that You may suffer or be subjected to while accessing Our Platform.
12. Unfair Gameplay: For Us, the safety and interests of the Users and fairness of the Games is of utmost importance. Any Game manipulation/unfair gameplay shall not be tolerated and We will take strict measures against such Users/Accounts engaging or attempting to engage in any Game manipulation, unfair gameplay or any unlawful or illegal activity.
13. User interactions: You acknowledge that You are solely responsible for all Your interactions and communications with other Users or with any other person on or off the Platform. You understand that the Platform is in no manner liable for Your interactions with any User or any other person through such User and any actions taken by You pursuant thereto.
14. If You engage in any conduct that violates these Terms or any other Platform Policy, engage in any Prohibited Conduct (as defined in Clause I (Prohibited Conduct & Fair Play) below), or attempt any unlawful, fraudulent or otherwise improper use of the Platform or Our Services or breach any Applicable Laws, We may restrict or terminate your use of the Services with immediate effect. We may also seek damages and take legal action against you as deemed necessary and appropriate.
Account Registration, Verification & Security
1. Registration
  1. To access or use the Platform Services, You must first create a User Account on the Platform. Account registration may be completed through any of the following methods, subject to verification and compliance requirements:
    1. By creating a unique username and password – Usernames must not be inappropriate, infringing, objectionable, offensive or unlawful, else they may be liable to be rejected;
    2. By registering using Your valid email address;
    3. By using a guest login option, where available. Users accessing the Platform via guest login may link such guest Accounts to their valid email or social media accounts or create their own Account in order to save their gameplay progress on the Platform; or
    4. By signing in through a supported Single Sign-On (SSO) service, including Google, Apple, or Facebook. By signing up through this mode, please note You will also be governed by the terms and conditions and privacy policies of such third-party platform. As We have no control over such external platforms, We recommend reviewing their policies carefully before creating your Account through this mode.
  2. Valid and accurate personal information: You are required to register on the Platform only using your own personal information, your current and valid credentials and declaration of Your age and jurisdiction. You agree and undertake to provide only accurate, current, valid and complete registration information.
2. Verification
  1. Identity verification - We may, at any time and at our sole discretion, request You to verify Your identity and eligibility to use the Platform. Verification may include submission of official identification documents, photographs, address proof, age proof, or any other information, documentation or manner of verification as lawfully permitted and necessary to verify your identity and compliance with Applicable Laws;
  2. We reserve the right to conduct customer verification as may be required from time to time at any stage as required under Applicable Laws or as deemed appropriate by Us, in the manner prescribed under Applicable Laws.
  3. All personal data and identification information collected for verification purposes shall be processed, stored, and protected in accordance with the Applicable Laws and our Privacy Policy for purposes prescribed thereunder.
  4. Failure, delay or refusal to complete the verification process may lead to restricted functionality or suspension or termination of Your Account.
3. Security
  1. Zaptech shall not be responsible for any loss, misuse of Your Account including any Virtual Items, or any unauthorized activity that may occur on account of You sharing Your Account credentials or granting access to a third party. You are solely responsible for maintaining the confidentiality and security of Your Account information, including your credentials and authentication details.
  2. Prohibition on Account Sharing/ Transfer
    1. Sharing or disclosure of Account credentials is strictly prohibited. You undertake not to share or transfer Your Account credentials to any person/ User/ entity/ group or third-party at any point of time, nor access the Platform through another User’s credentials, directly or indirectly.
    2. You cannot sell, gift, assign, license or transfer Your Account or any part thereof unless expressly permitted by Us in writing.
    The Platform is not responsible if Your Account is accessed or opened by others using your login details. You are responsible and liable for all actions from your Account, whether or not made by You.
  3. Prohibition on multiple Accounts - A User can play Games on the Platform by using and maintaining only one Account on the Platform at all times, using their own valid, current and accurate credentials. Users are prohibited to open/access multiple Accounts on the Platform, directly or indirectly. If a User attempts to do so or to use another User’s Account, We will be entitled to close all such Accounts and bar such Users from using the Services with immediate effect and take all such actions as deemed fit in our sole discretion.
  4. Prohibition on impersonation or furnishing false, inaccurate or misleading information - If there is any inaccuracy in the information furnished by You or if You are found using anyone else’s personal information, including any credential (or permitting someone else to use Your credentials) to register and/or use the Services of the Platform, We may, amongst other actions, forthwith suspend or terminate Your Account, without prejudice to any legal remedies available to Us under Applicable Laws.
  5. You agree to immediately notify PokerBoss of any unauthorized use of Your Account or any other suspected security breach. The Platform may take any measures it deems fit to protect Your Account, the Platform and other Users. For assistance regarding any security concerns, You may contact support@pokerboss.com.
Platform Services & Virtual Items
1. Nature of Service
  1. The Platform provides a simulated peer-to-peer free-to-play virtual poker gameplay experience solely for entertainment, recreational and skill-development purposes only. Each Game involves the application of a User’s knowledge, attention, training, memory, or strategic thinking.
  2. Any Virtual Items (including Virtual Chips) available on the Platform are provided solely for gameplay and entertainment purposes to be used within the Platform environment only. They have no real-world or monetary value whatsoever and cannot be redeemed, withdrawn, transferred, exchanged, encashed or converted (directly or indirectly) for real money or any item of monetary or tangible value in the real world.
  3. Users on the Platform can play Games on the Platform generally (lobby games). They also have an option to create or join a club or league on the Platform, if they so desire. For further information on these, please see Clause K (Clubs & Leagues) below, the Clubs & Leagues Agreement and Frequently Asked Questions.
  4. Gameplay is conducted using free Virtual Chips provided to all Users. Users may replenish their balances with additional Virtual Chips through daily bonuses, in-game activities, or other free tasks within the Platform. Virtual Chips/Items may be utilized, won or lost within the gameplay for entertainment purposes only, or, utilized for enhancing the cosmetics of the Games for Users. While Users may also purchase additional Virtual Items through In-app purchases, such purchases are entirely optional. For club Games, all club members will be provided free Virtual Chips by the club admin for participation in the club Games. No purchase or payment is required to participate in any Game offered on the Platform.
  5. To simulate a real gameplay experience, a non-monetary virtual rake may be applied to Games played in the lobby and in clubs solely for gameplay balancing, whereby a fixed percentage or amount of Virtual Chips is automatically deducted from each round of a Game. The deducted Virtual Chips do not have, and cannot be converted into, any monetary value. All such deductions are purely virtual, non-redeemable, and have no monetary value or financial implication for the Platform or Users. The application of such rake does not constitute a fee, charge, commission, stake, or consideration of any kind. The Platform does not receive or realize any monetary or real-world value from rake, and it does not relate to any real-money gaming activity.
  6. Users agree and acknowledge that the (i) Virtual Chips/Items are purely for entertainment purposes, personal and non-commercial use; (ii) the gameplay does not involve or permit any form of stakes or wagers of money or other stakes; (iii) gameplay does not result in any real-world monetary gain or enrichment. Users acknowledge and agree that they cannot earn, receive, or redeem any real-world prizes, rewards, winnings, payouts, benefits, consideration, or money through the use of such Virtual Chips or Items.
2. Virtual Items having no Real-world/Cash Value
  1. No Monetary Value: Virtual Items available on the Platform possess no real-world or monetary value. They are neither equivalent nor convertible to money, money’s worth, or other stakes, nor can they be redeemed, withdrawn, transferred, exchanged, encashed, or otherwise converted, directly or indirectly, into real money or any item of monetary or tangible value. It is clarified however that diamonds acquired via In-app purchase may be further exchanged for Virtual Chips, such as green chips and gold coins, purely for the purposes of facilitating gameplay on the Platform.
  2. No Representation of Money: Under no circumstances shall any Virtual Item be construed or deemed to represent money, money’s worth, or any equivalent of monetary stakes. The Platform does not provide any prizes, rewards, winnings, or payouts that represent money, money’s worth, or any equivalent of monetary stakes.
  3. Purely Recreational Nature: The use or depletion of Virtual Items by Users shall not result in any gain or loss of real-world monetary value. Users do not stand to gain any real-world value on receiving, utilizing or extinguishing such Virtual Items. The use of Virtual Items is solely for recreational and entertainment purposes within the Platform. The gameplay or participation in any activity involving Virtual Items on the Platform does not entail staking, wagering, or risking of money or money’s worth, and does not constitute promoting, facilitating, offering, aiding, abetting an online money game, gambling, or betting activity under any Applicable Law.
  4. Prohibition on Real-World Transfer or Exchange: Virtual Items have no real-world monetary value and are made available solely for personal, non-commercial, and entertainment use within the Platform. They are strictly non-transferable outside the Platform and cannot be sold, traded, staked, exchanged, redeemed, bartered or otherwise converted for cash or any item or benefit of real-world value. Users agree and undertake not to engage in, facilitate, induce or attempt any transfer, exchange, or transaction involving Virtual Items or any Service outside the Platform. Any such activity is unauthorized, void, and constitutes a material breach of these Terms. The Platform expressly disclaims any responsibility or liability arising out of or in connection with any such external exchange, transfer, or misuse of Virtual Items or any other Platform Service by Users. You further represent and warrant that You will not attempt or use the Platform in any manner to aid, abet, facilitate, engage or induce other Users to engage in such prohibited activities. The Platform reserves the right to take appropriate action against You including but not limited to immediate termination, permanent blocking of access, notifying the concerned authorities in case of any such prohibited activities or attempts thereof.
3. Licenses & Ownership
  1. Subject to Your compliance with these Terms, other Platform Policies and all Applicable Laws, You are granted a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Platform, its Services and any associated Virtual Items within the Platform solely for personal, lawful, and non-commercial use as per the Platform Policies and Applicable Laws and only for as long as Your Account remains active and in good standing.
  2. This license does not convey any ownership, proprietary, economic or intellectual property rights or interest in the Platform including but not limited to its software, content, or any Virtual Items made available therein. We retain exclusive ownership and all rights, title and interest in and to the Platform and all associated Intellectual Property.
  3. Notwithstanding anything contained in any of the Platform Policies, You acknowledge that You do not own the User Account that you create on our Platform nor any Virtual Items that you received on the Platform. Your Account and any related Virtual Items are exclusively owned by the Platform. The Platform only gives you the aforesaid limited license to access the Services and play Games thereat only for the duration of Your Account on the Platform subject to your compliance with the Platform Policies and Applicable Laws.
4. Right to modify, suspend or discontinue any Services: The Platform reserves the right, at its sole discretion, to add, modify, update, suspend, limit access to, or discontinue any part of its Services, including any Games, features, functionalities, or content, in whole or in part, in any jurisdiction, either temporarily or permanently, at any time and without prior notice or obligation to provide reasons with no liability to any User. The Platform shall not be liable for any loss, damage, or inconvenience arising from such modification, suspension, or discontinuation, and Users shall have no claim or right to compensation, reinstatement, or refund in this regard. If a User does not agree with any such change, they may deactivate their Account at any time.
5. Expiry & Forfeiture
  1. Your Account and any associated Virtual Items may be suspended, restricted, expired, or permanently removed by the Platform under certain circumstances, including but not limited to: suspected or confirmed fraudulent or unauthorized activity, prolonged Account inactivity, directions, requests or inquiries from law enforcement or regulatory authorities, suspected or confirmed violation of Platform Policies any Applicable Laws or concerns relating to prohibited forms of online gaming in any jurisdiction, money laundering or terrorist financing, or any other User activity deemed by Us to be inappropriate, harmful or detrimental to the integrity, security, or lawful operations of the Platform and interests of other Users.
  2. PokerBoss reserves the right to take any such action at its sole discretion, without prior notice, to ensure compliance with all Applicable Laws and to maintain the integrity and security of the Platform.
  3. Your limited license to use the Platform and its Services automatically suspends in case of Account suspension/restriction and terminates upon the closure or termination of Your Account.
  4. You agree that upon closure or termination of your Account due to violation of Platform Policies, You shall not attempt to access the Platform through any direct or indirect means and you further acknowledge that the Platform shall bear no responsibility whatsoever for the loss of any such access.
6. Compliance with Applicable Laws
  1. The Platform and its Services are intended solely for lawful entertainment, recreational and skill-development purposes in compliance with Applicable Laws.
  2. Users are required to access and use the Services of the Platform responsibly and in full compliance with all Applicable Laws of their country of residence. It is the Users’ sole responsibility to ensure that their use of Platform Services always complies with the respective Applicable Laws and the Platform Policies.
  3. Users must not directly or indirectly use, attempt to use or cause or permit to use the Platform, its Services or any of its features for any unlawful, fraudulent or illegal purpose or in any manner that alters, circumvents, or misrepresents the lawful and intended nature and operations of the Platform and its Services. The Platform strictly forbids such conduct and this constitutes a material breach of these Terms.
  4. Users acknowledge that they are solely responsible and liable for ensuring compliance with all Applicable Laws and Platform Policies and for any consequences, liabilities or penalties arising from any non-compliance thereof or any misuse of the Platform.
  5. If it is discovered, or brought to Our attention, that an Account has been used/is being used or attempted to be used for any illegal, prohibited or non-compliant activity, including any suspected or actual violation of any of the Applicable Laws or the Platform Policies, We reserve the right to immediately suspend, restrict, terminate Your Account or permanently block access to Our Services and take any actions as deemed fit against such conduct in our sole discretion, including reporting to concerned legal authorities and undertake any other legal or remedial action as deemed appropriate.
In-App Purchases, Payment & Refunds
1. Users are under no obligation to purchase any Virtual Items (including Virtual Chips) at any point of time. All Games are free to participate and play.
2. As part of its In-app purchases, the Platform may offer optional VIP packs from time to time. These packs may provide access to optional enhanced features such as supplementary information, convenience tools, and cosmetic elements designed solely to augment User experience without impacting gameplay in any manner. Such features may include probability estimates, statistical insights, extended reconnection time, performance reports, additional emojis, increased club-creation limits, etc. The purchase of a VIP pack is neither in the nature of a stake, wager, or entry fee or consideration for winnings, nor does it offer any real-world, monetary, or redeemable rewards. It is purely for in-app use on the Platform and has no real-world value whatsoever. VIP features may vary by pack, are subject to availability, and may be changed, modified, or discontinued at the Platform’s sole discretion. They are subject to all conditions applicable to In-app purchases as outlined in these Terms and other Platform Policies.
3. The Platform reserves the right, at its sole discretion, to modify, regulate, suspend, remove, revoke or discontinue the availability of any Virtual Items at any time or Your license to use the same for any reason, without notice or liability to You.
4. Virtual Items can only be purchased by Users of jurisdictions where such purchase and access to and use of the Services is permitted under the respective Applicable Laws. Users acknowledge that the Platform or the third-party app store are entitled to refuse any request for purchase or acquisition of any Virtual Items at their sole and absolute discretion.
5. Availability and usage rights of Virtual Items may vary by item or by jurisdiction and subject to change without notice. You are responsible for regularly reviewing the applicable terms of such Virtual Items and being aware of the Applicable Laws governing your jurisdiction.
6. The Platform can place limits on the quantity of Virtual Items that can be purchased or held by a User at any point of time.
7. Any Virtual Item purchased is subject to these Terms, any specific Item terms, other Platform Policies, policies of third-party app stores, and Applicable Laws.
8. Payment Mechanism
  1. All purchases for Virtual Items (including Virtual Chips) can be made via third-party In-app purchase (IAP) platforms belonging to the Apple App Store or Google Play Store, as the case may be.
  2. Once an In-app purchase transaction is successfully processed through the authorized channels (such as the Apple App Store or Google Play Billing System) and the corresponding Virtual Items are credited to Your Account, Our service obligation with respect to that transaction is deemed fully completed with no further obligation on our part. All such purchases are final, non-transferable, and non-refundable, except where otherwise required under Applicable Law.
  3. The amount charged for each In-app purchase is inclusive of any applicable charges and taxes. Once credited, any use or non-use of Virtual Items within the Platform, including gameplay, features, cosmetics or any other activity within the Platform is entirely at User’s discretion.
9. The Platform will not be responsible to any User for any issues beyond its control, including but not limited to internet connection inconsistency, service outage, power outage, malware attack, viruses, computer malfunction, natural disasters, or other unforeseeable failures, etc. By using our Services, you acknowledge and accept that the Platform is not liable for any losses incurred by a user vis-à-vis their In-app purchase, refund request, accessing any purchased feature offered by the Platform, amongst others.
10. Pricing & Taxes
  1. Prices and availability of Virtual Items may vary by region and are subject to change without notice.
  2. You are responsible for payment of all applicable taxes, duties, charges and fees while making any In-app purchases.
11. Non-Refundable / Final Sale
  1. All In-App Purchases are final, non-refundable, and non-reversible, except where required by Applicable Laws. The Platform has no obligation to provide refunds or compensation for any unused, expired, removed, revoked or lost Virtual Items;
  2. In exceptional cases (such as system errors, duplicate charge), We may permit issue of refunds by the third-party app store at Our sole discretion. Users agree and acknowledge that the Platform reserves full rights to decline such requests.
12. Chargebacks & Reversals
  1. PokerBoss shall not be liable for any claims, reversals, or chargebacks arising after successful fulfillment of the purchase. Initiating or attempting to initiate a chargeback or payment reversal for a successfully completed In-app purchase without legitimate grounds is strictly prohibited. All payments made for Virtual Items or In-app purchases are considered final and non-refundable, except where mandated by Applicable Laws.
  2. In the event of any chargeback, payment reversal, or dispute initiated through Your payment provider, PokerBoss reserves the right, at its sole discretion, to:
    1. Revoke or remove the corresponding Virtual Items or credits from Your Account;
    2. Suspend, restrict, or permanently terminate Your Account; and/or
    3. Initiate legal or recovery proceedings to reclaim the disputed amount and any associated costs.
  3. PokerBoss further reserves the right to report any such activity to relevant payment processors, app store operators, or regulatory authorities where such conduct is deemed fraudulent or abusive.
13. Compliance with App Store Rules
  1. All In-app purchases must strictly comply with and be governed by the terms, conditions, and payment policies established by the respective third-party app store or distribution platform (including but not limited to Apple App Store and Google Play Store) as well as their respective third-party payment gateways and service providers.
  2. PokerBoss shall remain in compliance with any policy updates, refund frameworks, or procedural changes introduced by the respective third-party app store operators. Users acknowledge that certain refunds, billing adjustments, or reversals may be governed directly by Apple or Google, as applicable, in accordance with their respective policies.
  3. You acknowledge that financial transactions pertaining to any In-app purchases are made through third-party app stores and payment gateways, which independently control transaction approval or denial under their own terms. Accordingly, the Platform is not a party to these transactions and bears no liability for any denials, failures, or other transaction-related issues.
  4. You acknowledge that these Terms form an agreement between You and Zaptech Media Limited only, and not with Apple Inc. or Google LLC. Neither Apple Inc. nor Google LLC is responsible for the Platform’s performance, maintenance, or compliance. All claims, including intellectual property or consumer disputes, shall be directed solely to Zaptech Media Limited.
14. Consumer Protection Laws
  1. Where applicable consumer protection laws mandate refund rights for digital goods, PokerBoss shall comply with the minimum statutory obligations prescribed under such laws in the relevant jurisdiction.
  2. Except where expressly required by law, all In-app purchases and delivery of Virtual Items are deemed final upon successful completion of the transaction. Users located in jurisdictions that provide enhanced consumer protection rights may exercise such rights solely to the extent recognized and enforceable under the relevant Applicable Laws.
Prohibited Conduct & Fair Play
1. Users are strictly prohibited from engaging in any activity that undermines the integrity, security, fairness, or lawful operation of the Platform; interferes with the Platform’s compliance of Applicable Laws or its internal governance and operational policies, including Platform Policies; or affects the safety and interests of other Users on the Platform. Without limitation and in addition to any other unlawful conduct highlighted in these Terms or other Platform Policies, the following actions constitute Prohibited Conduct and shall be deemed a material breach of these Terms:
  1. Engaging in, facilitating, or promoting any form of online money games, real-money gambling, wagering, or betting (including any attempt thereof), through, within, or in connection with the Platform or its Services (including its features), directly or indirectly. If You are found using or attempting use of any Platform Services or features to facilitate, engage or permit or cause to permit any such prohibited activity, strict action will be taken against You.
  2. Selling, bartering, exchanging, or otherwise transferring Virtual Items, in-app credits, or User Accounts for any real-world currency, value, goods, or services, whether directly or through third-party intermediaries or in any manner inducing or facilitating other Users to do so. The Platform strictly prohibits any attempt to transfer, gift, buy, sell, trade or exchange any Virtual Chips/Items for any anything of real-world value or inducing, promoting or facilitating thereof. The Platform does not recognize, validate, or accept responsibility for any such external transactions or their consequences. You are not allowed to sublicense, trade, sell, or attempt to sell Virtual Items for real money, or exchange Virtual Items for any real-world value outside the Platform. Any such transfer/arrangement or attempt thereof is prohibited and void, and we are entitled to terminate Your Account and take legal action against You.
  3. Participating in any activity intended to manipulate gameplay outcomes, creating unfair advantage or unfair gameplay, including but not limited to collusion, chip dumping, team play, shared decision-making, chat abuse, misuse of chat features, multiple User Accounts, use of external player assistance programs and bots, dishonest or fraudulent behaviour, or disclosure of concealed information among Users, etc. For ease of understanding:
  4. Attempting to reverse engineer, decompile, disassemble, tamper with, or hack the Platform, its servers, databases, or related systems, or otherwise gain unauthorized access to any data or functionality.
  5. Directly or indirectly using, attempt to use, causing or permitting to use the Platform, its Services or any of its features for any unlawful, fraudulent or illegal purpose or in any manner that alters, circumvents, or misrepresents the lawful and intended nature and operation of the Platform and its Services.
  6. Using VPNs, proxy servers, IP spoofing, or other obfuscation methods to conceal identity, location, or to circumvent regional restrictions, anti-collusion systems, or gameplay monitoring protocols.
  7. Posting, transmitting, or displaying any abusive, threatening, harassing, defamatory, coercive, obscene, offensive, or unlawful content, including spam, hate speech, or material that infringes upon the rights or dignity of others or attempts to interrupt, destroy, or limit the functionality of our Service.
  8. Threatening, coercing, defaming, harassing, bullying, offending, or engage in offensive communication with Us, our employees, representatives, Our service partners and other Users.
  9. Advertising, promoting, or facilitating access to any external gambling, betting, wagering or online money gaming platforms or to any prohibited activity, website or portal, whether directly or indirectly, through any feature or functionality of the Platform.
  10. Providing false, misleading, or fraudulent information, impersonating any individual or entity, or engaging in any activity constituting identity theft or misrepresentation.
  11. Failing to report any unauthorized activity or use of Your Account or of your subsequent ineligibility to access the Services of the Platform in accordance with the Eligibility criteria under these Terms and the relevant Applicable Laws.
  12. Attempting to commit any action which is not in compliance with the Applicable Laws or these Terms and/or any other Platform Policy(ies);
  13. Attempting to use the Platform, its Services, features or functionality for any illicit or unlawful purpose, engaging in prohibited financial transactions or activities prohibited under Applicable Laws; or
  14. Attempting to engage in, promoting or making false, misleading, or unauthorized representations relating to the Platform.
2. PokerBoss reserves the right, at its sole discretion, to take appropriate enforcement measures in response to any actual, attempted, or suspected violation of these Terms or other Platform Policies, which may include, but are not limited to:
  1. Issuance of warnings, temporary suspensions, or permanent bans of User Accounts;
  2. Confiscation or revocation of Virtual Items, in-app virtual currency, or related benefits obtained through prohibited means;
  3. Cancellation, forfeiture, or nullification of any game results, tournament standings, or Promotions/rewards determined to have been affected by misconduct;
  4. Restriction or termination of access to all or any part of the Platform Services; and
  5. In cases of serious or repeated misconduct, reporting to concerned authorities, initiation of legal proceedings, including civil and criminal remedies, seeking damages and/or injunctive relief to prevent further violations in addition to any other remedies as provided in these Terms or under Applicable Laws.
3. Users acknowledge that PokerBoss retains full discretion to investigate and determine any attempt or actual violations of this Clause, and that its decisions in such matters shall be final and binding.
Anti-Fraud, Monitoring & Investigations
1. To ensure the integrity, security, and fair use of the Platform, PokerBoss employs continuous and automated monitoring systems. Such systems may analyze user behavior, gameplay patterns, device identifiers, IP addresses, GPS data, network information, transaction records, and activity logs to detect and prevent any irregular, fraudulent, or unlawful activity, including but not limited to collusion, chip dumping, bot usage, external player assistance programs, account sharing, or multi-accounting.
2. All data collected through such monitoring shall be processed and retained in accordance with applicable data protection and privacy laws, as detailed in the PokerBoss’ Privacy Policy.
3. If any suspicious or anomalous activity is detected, or if PokerBoss reasonably believes that Your actions may violate these Terms, other Platform Policies or Applicable Laws, PokerBoss reserves the right to:
  1. Temporarily suspend or freeze Your Account pending investigation;
  2. Request identity verification documents, proof of address, or other supporting information to validate Account ownership and activity;
  3. Delay or withhold bonuses, Promotions or any in-app benefits (where applicable) until the conclusion of the investigation; and
  4. Reverse, cancel, or nullify transactions or gameplay outcomes determined to have been influenced by Prohibited Conduct.
4. You expressly agree to fully cooperate with any investigation initiated by PokerBoss or its authorized representatives. Failure or refusal to cooperate may result in Account suspension, termination, or permanent forfeiture of Virtual Items or related privileges.
5. PokerBoss reserves the right to disclose user information, gameplay data, and transaction logs to law enforcement agencies, regulatory authorities, courts, or other governmental bodies if such disclosure is:
  1. Required under Applicable Laws;
  2. Made pursuant to a lawful order, warrant, or government request; or
  3. Deemed necessary by PokerBoss to protect its legal rights, enforce its Terms, prevent fraud, or ensure compliance with anti-money laundering (AML), counter-terrorism financing (CTF), or other statutory obligations.
  4. Such disclosures may occur without prior notice to the user, where legally permissible.
6. PokerBoss may preserve, retain, and store user data, including gameplay records, communication logs, and transaction history, during and after the course of any investigation, including after account suspension or termination, for the following purposes:
  1. Regulatory or legal compliance;
  2. Audit and fraud prevention; and
  3. Law enforcement or judicial proceedings, where necessary.
7. All such data shall be maintained for the duration mandated by applicable data retention laws and securely deleted thereafter in accordance with PokerBoss’s Privacy Policy.
Clubs & Leagues
1. The roles that may be assumed by a User in respect of clubs and leagues on the Platform are governed by a specific Clubs & Leagues Agreement at the time of a User creating/ entering a club or league, as the case may be. The general terms and conditions regarding such clubs and leagues are provided hereinbelow:
  1. Membership of Clubs
    1. Users may create or join clubs. To join a club, Users would be required to enter the unique club ID along with the corresponding referral ID received upon being invited to the club.
    2. You have the right to enter and exit clubs or tables thereunder at any time and acknowledge that You enter clubs at Your own discretion. You hereby agree and acknowledge that the Platform is not responsible for any actions taken by You within a club.
    3. Users can become a member of more than one club. Accordingly, the User’s balance of Virtual Chips will vary in each club they are a member of depending on their performance in each such club.
  2. Club Management and Dispute Resolution
    In case of a dispute between two or more players or between club management and any player, primary responsibility for resolving disputes is of the respective club management. Players will first raise concerns directly with the club admin who shall seek to resolve such dispute within fifteen (15) days from the date of receipt of a written complaint. Such disputes will be resolved under the club’s terms. Where a complaint alleges breach of these Terms, Platform’s fair-play policy or security rules, the Platform may at its sole discretion review logs, hand histories and Account activity. In such cases, Platform decisions would be limited to Platform-level actions including warnings, suspensions, club restrictions, etc. in accordance with these Terms, other Platform Policies and Applicable Law. In case a user is not satisfied with the decision rendered by club admin, they may escalate the issue to the Platform which shall seek to resolve the issue as specified in these Terms.
  3. Private Tables - Users may invite other registered Users to join private tables within clubs (“Tables”) within the Platform. All such Games are governed by the same Terms and restrictions as applicable to all Games on the Platform.
User Content, Communication, and Feedback
1. The Platform may allow Users to create, generate, select, transmit, upload, post, share or display certain forms of content, including but not limited to chat messages, profile/Account details, pre-approved avatars, in-app communications, comments, reviews, email correspondence with the Platform and any and all other submissions or content by Users (“User Content”). Users are not permitted to upload custom images or photos for avatars and may only select from the list of avatars made available within the Platform.
2. By submitting or making any User Content available through the Platform, You hereby:
  1. Grant PokerBoss a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from such User Content for the purposes of operating, maintaining, promoting, or improving the Platform and related Services;
  2. Represent and warrant that You are the lawful owner of the User Content, or otherwise possess all rights, consents, and permissions necessary to grant the license above;
  3. Warrant that Your User Content does not infringe upon or violate any third-party rights (including intellectual property, privacy, or publicity rights), and does not contravene any Applicable Laws or Platform Policies; and
  4. You retain ownership of your User Content, subject to the license granted to PokerBoss under this clause.
3. PokerBoss reserves the right, but is under no obligation, to monitor, review, pre-screen, edit, remove, or disable access to any User Content at its sole discretion, particularly where such content is found or reasonably suspected to:
  1. Violate these Terms, other Platform Policies or any Applicable Laws;
  2. Promote, facilitate, or engage in any external exchange, sale, transfer, arrangement, or settlement involving Virtual Items or Platform features for any form of real-world value or consideration, whether monetary or otherwise, or inducing others to do so;
  3. Contain defamatory, obscene, abusive, hateful, or otherwise objectionable or offensive material;
  4. Infringe upon any intellectual property or proprietary rights; or
  5. Pose a risk to the safety, reputation, or integrity of the Platform or its Users or interferes in their compliance of Applicable Laws.
4. The Platform may include in-game chat functionality and community interaction features (“Community Features”) enabling Users to engage in communication while participating in gameplay. Users may interact through chat only within the game table.
  1. Users acknowledge that PokerBoss does not actively monitor all communications and is not responsible for any statements, opinions, or content shared by Users.
  2. PokerBoss reserves the right to monitor, record, audit, or remove any communication at its sole discretion, including without limitation for the purposes of law enforcement, regulatory compliance, or ensuring the safety and integrity of the Platform and for safety and interests of other Users.
  3. Users agree that communications conducted through the Platform are not private and may be disclosed to law enforcement or regulators as deemed necessary or required under Applicable Laws.
5. Users agree and undertake that they shall not use chat, comment, or any other communication features of the Platform to:
  1. Post or transmit content that is abusive, defamatory, obscene, harassing, or unlawful;
  2. Promote or facilitate online money games, real-money gambling, wagering, staking or betting activities outside of PokerBoss, including through links, referrals, or invitations to external sites, applications, or groups;
  3. Promoting, facilitating, or engaging in any external exchange, sale, transfer, arrangement/settlement etc. pertaining to any Virtual Items or Platform features for any real-world value or consideration (monetary or otherwise), or encouraging other Users to do so.
  4. Commit or attempt to commit any unauthorized activity, engage in Prohibited Conduct, breach or attempted breach of any Platform Policy or Applicable Laws;
  5. Distribute spam, unsolicited advertisements, or chain messages;
  6. Impersonate another person, misrepresent identity, or falsely claim affiliation; or
  7. Upload or transmit any software, virus, or malicious code that may harm the Platform or other Users.
6. PokerBoss may, at its sole discretion and without prior notice, suspend, restrict, or revoke any User’s access to chat, comment, or Community Features if such User is found or suspected to be engaging in prohibited conduct, unlawful behaviour or violating these Terms, any other Platform Policy or any Applicable Laws.
7. From time to time, Users may provide PokerBoss with ideas, suggestions, recommendations, feature requests, comments, or other feedback regarding the Platform and its Services (“Feedback”).
8. By submitting such Feedback, you acknowledge and agree that:
  1. Your submission is voluntary and non-confidential;
  2. PokerBoss shall have the unrestricted right to use, reproduce, modify, adapt, disclose, commercialize, and otherwise exploit such Feedback without any obligation to compensate or credit you; and
  3. You hereby irrevocably assign to PokerBoss all rights, title, and interest (including intellectual property rights) arising from or relating to such Feedback.
9. Users must not engage in any form of bullying, intimidation, harassment, stalking, discriminatory conduct (based on gender, race, religion, nationality, disability, or sexual orientation) or any offensive or objectionable conduct. PokerBoss reserves the right to suspend or terminate Accounts engaging in such conduct and may report or cooperate with law enforcement authorities where necessary.
10. While PokerBoss may moderate or review content, it assumes no responsibility for monitoring all communications or content shared by Users and disclaims any liability arising from user conduct, User Content, misuse or wrongful use of Community Features or any other Platform feature or any third-party interactions on and outside the Platform.
11. Users acknowledge that they may engage with other Users on or outside the Platform at their sole discretion, risk and consequences. The Platform is not liable or responsible for any interaction/communication amongst Users nor any actions they take in furtherance thereof. Users agree and acknowledge to keep Us indemnified against any claims, actions, losses or damages that We may be subjected to arising from or in connection with such User interaction.
Intellectual Property Rights
1. All rights, title, and interest in and to the Platform, including but not limited to its software, source code, algorithms, architecture, design, graphics, user interfaces, databases, text, audio-visual content, artwork, animations, logos, trademarks, trade names, service marks, brand elements, game logic, features including Virtual Items, and all content, material and associated technologies (collectively, the “Intellectual Property”), are and shall remain the exclusive property of Zaptech or its respective affiliates, partners, or licensors.
2. Nothing in these Terms shall be construed as transferring, assigning, or granting any ownership rights to You in respect of the Intellectual Property or any component thereof. All rights not expressly granted under these Terms are reserved by Zaptech and its licensors.
3. Subject to Your continued compliance with these Terms and Applicable Laws, Zaptech grants You a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Platform and its Services solely for lawful, personal, and entertainment purposes.
4. This license does not include any right to:
  1. Use the Platform or its Intellectual Property for any commercial, promotional, or revenue-generating activity;
  2. Modify, adapt, or alter the Platform or any part thereof; or
  3. Exploit any content, code, or material from the Platform for competitive, unlawful, or unauthorized purposes.
5. This license will automatically terminate if You breach these Terms or if Your Account is suspended or terminated.
6. Except as expressly permitted under these Terms or Applicable Laws, You shall not, whether directly or indirectly:
  1. Copy, reproduce, modify, distribute, sell, lease, rent, or sublicense any part of the Platform or its Intellectual Property;
  2. Decompile, disassemble, reverse-engineer, or otherwise attempt to derive the source code or underlying structure of the Platform;
  3. Remove, obscure, or alter any proprietary notices, copyright marks, or trademark designations appearing on the Platform;
  4. Use any automated systems, bots, scripts, or scraping tools to access or interact with the Platform; or
  5. Circumvent, disable, or tamper with any security, anti-cheating, or technical protection mechanisms implemented to safeguard the Platform or user data.
7. Except for the limited license expressly granted above, no rights (whether implied, equitable, or otherwise) are granted to You in respect of the Platform or any of its Intellectual Property. Any unauthorized use, reproduction, modification, distribution, or exploitation of the Platform or any of its Intellectual Property (or permitting or causing any other person to do so) shall constitute a material breach of these Terms and may result in immediate suspension or termination of Your Account and legal action under Applicable Laws, including civil and/or criminal liability, and injunctive relief under Applicable Laws.
Responsible Play
1. PokerBoss is designed solely for entertainment and recreational purposes. We are committed to promoting a safe, balanced, and responsible gaming environment for all Users.
2. You agree and undertake to use the Platform responsibly, engage in gameplay for fun and social enjoyment only, and to avoid excessive play patterns. PokerBoss encourages Users to take regular breaks, maintain balance with real-life activities, and make informed choices about their time spent on the Platform.
3. If at any point You feel that the gameplay is affecting Your well-being or daily life, You are encouraged to pause or discontinue use of the Platform and seek support or guidance from trusted sources.
4. To this effect for the safety and well-being of Users, the Platform also provides the tools and options for Users for placing daily, weekly and monthly limits on screen-time and In-App Purchases, option for self-exclusion for a User-prescribed time, in addition to other responsible play features made available on the Platform from time to time. All Users are encouraged to make use of such tools and options, when required.
Promotions, Rewards & Bonus Virtual Items
1. From time to time, Zaptech, may, at its sole discretion, organize or offer tournaments (with Virtual Chips as prizes), promotional campaigns, limited-time offers, giveaways of Virtual Items, bonus Virtual Items, loyalty schemes, referral programs, or other reward-based initiatives (collectively, “Promotions”). No User will be required to pay any entry fees to participate in any Promotion.
2. All Promotions, contests, and reward programs offered on the Platform are organized solely for entertainment and user engagement purposes and do not, under any circumstances, constitute or involve any form of real-money gaming, staking, wagering or gambling activity under Applicable Laws.
3. Participation in such Promotions shall be governed by:
  1. Any specific terms, eligibility requirements, rules, or conditions published by PokerBoss for the relevant Promotion (Promotion Terms /Feature Terms), as may be detailed in the Frequently Asked Questions (“FAQs”) or other official communications;
  2. These Terms and other Platform Policies; and
  3. Applicable Laws.
4. In the event of any inconsistency or conflict between these Terms and the FAQs or specific Promotion Terms, the latter shall prevail solely in relation to that specific Promotion, to the extent of such inconsistency.
5. PokerBoss reserves the absolute right, at any time and without prior notice, to amend, withdraw, suspend, or terminate any Promotion, discount, offer, or promotional program, either in part or in whole, for any reason, including but not limited to:
  1. Technical or operational issues;
  2. Suspected misuse, abuse, or fraudulent activity; or
  3. Compliance with Applicable Laws, third-party app store requirements, or internal policy decisions.
6. Users acknowledge and agree that Zaptech may exercise this right at its sole discretion without prior notice, and Users shall have no claim, right, or objection in respect of such modification, suspension or discontinuation.
7. Such Promotions or offers shall not, under any circumstance, be construed as or equated with a refund, cashback, redemption, winnings, consideration or reimbursement of any amount or deposit made by the User.
8. Any bonus Virtual Items, promotional chips, loyalty credits, or other in-app rewards issued as part of a Promotion shall be subject to the following conditions:
  1. Expiry and Validity - Bonus Virtual Items may carry a fixed validity period and shall automatically expire if unused within the specified timeframe or upon Account inactivity, as determined by PokerBoss.
  2. Usage Limitations – Such Virtual Items can only be used within the Platform and cannot be exchanged, redeemed, transferred, withdrawn, or converted into cash or any monetary equivalent.
  3. Revocation and Forfeiture - PokerBoss reserves the right to deduct, cancel, or reclaim any bonus Virtual Items, rewards, or promotional credits if any fraudulent, deceptive, or abusive activity or Prohibited Conduct is detected, or if a User is found in violation of these Terms, the Promotion Terms, other Platform Policies or Applicable Laws.
  4. No Cash/Real-world Value - Bonus Virtual Items and promotional rewards are not legal tender, they do not represent a monetary balance or storage of value, and hold no intrinsic cash, property or any real-world value. They exist solely for entertainment and gameplay purposes within the Platform. Users do not stand to gain or lose any real-world value on their acquisition, use or depletion in the Platform.
9. PokerBoss does not guarantee the availability, continuity, or frequency of any Promotion, bonus, or offer. Users acknowledge and agree that:
  1. Participation in Promotions is voluntary and does not create any contractual right or entitlement to future benefits, rewards, or offers;
  2. PokerBoss is under no obligation to continue or reintroduce any Promotion once discontinued; and
  3. PokerBoss shall not be liable for any loss, disappointment, or perceived disadvantage arising out of any modification, suspension, or termination of a Promotion.
10. In addition to these Terms, all Promotions, discounts, and reward programs shall be subject to their respective specific promotional conditions as communicated by PokerBoss. Users are deemed to have read, understood, and accepted such additional conditions upon participation. Therefore, You are advised to carefully review the terms of any such Promotion, discount, reward programs, etc. before entering or participating thereunder.
11. The interpretation, eligibility, and outcome of any Promotion shall be determined exclusively by PokerBoss, and its decision shall be final in all respects and binding on all participants.
Third-Party Content & Advertising
1. From time to time, the Platform may display, transmit, or make available advertisements, promotions, sponsorships, or offers originating from third parties (“Third-Party Content”). Such Third-Party Content is provided solely for informational or promotional purposes.
2. PokerBoss does not endorse, guarantee, or assume any responsibility for:
  1. The accuracy, reliability, legality, or quality of any Third-Party Content;
  2. The fulfilment, delivery, or performance of any goods, services, or rewards offered by third parties; or
  3. Any transaction or interaction between you and such third parties, whether through external websites, in-app banners, or other channels.
3. Your participation in, or reliance upon, any Third-Party Content is entirely at your own risk, and PokerBoss shall not be liable for any loss, damage, or dissatisfaction arising therefrom.
4. The Platform may, for your convenience, include links or redirects to third-party websites, services, or applications that are not owned, operated, or controlled by PokerBoss.
  1. You acknowledge and agree that:
    1. PokerBoss does not exercise control over such third-party platforms, their operations, data handling, or content;
    2. Accessing such third-party links shall be at your own discretion, consequence and risk; and
    3. PokerBoss expressly disclaims any and all liability arising from your use of or reliance on any Third-Party Content including third-party websites, content, or service.
  2. It is your sole responsibility to review the terms, privacy policies, and practices of any third-party website or service prior to engaging with it.
5. Users are strictly prohibited from:
  1. Advertising, promoting, or facilitating real-money gambling, betting, or external staking platforms through any part of the Platform (including chat, clubs, or profile content);
  2. Sharing, displaying, or distributing unauthorized marketing materials, affiliate links, or solicitation messages; or
  3. Engaging in any promotional activity that violates third-party app store policies, Applicable Laws, or these Terms or other Platform Policies.
  Violation of this clause shall constitute a material breach of these Terms and may result in immediate Account suspension or permanent termination, along with any other legal action deemed appropriate by PokerBoss.
Privacy, Data & Compliance
1. The collection, use, storage, processing, and disclosure of your personal information while accessing or using the Platform is governed by Our Privacy Policy, which forms an integral part of these Terms. Users are advised to review the Privacy Policy in detail to understand how their personal data is handled, including the purposes of processing, data sharing practices, and available safeguards.
2. PokerBoss is committed to maintaining the highest standards of privacy and data protection. We process personal data in a lawful, fair, transparent, and secure manner, consistent with applicable global data protection principles and we have implemented appropriate technical and organizational measures to ensure the security, confidentiality, integrity, and availability of user data and to prevent unauthorized access, disclosure, or misuse.
3. As required by third-party app distribution platforms, such as the Apple App Store and Google Play Store, PokerBoss ensures that all relevant privacy disclosures, consent mechanisms, and permissions are easily accessible within the Platform interface or accompanying documentation. These disclosures are intended to help Users understand how data is collected, used, shared, and stored when using the Platform and its Services.
4. PokerBoss respects and upholds the rights of all Users regarding their personal information. Subject to applicable laws and technical feasibility, Users may exercise their data-related rights by submitting a request through the channels specified in the Privacy Policy. PokerBoss will review, verify, and respond to such requests in a fair, lawful, and timely manner, in accordance with applicable privacy principles and internal compliance standards.
5. PokerBoss may collect and use aggregated, de-identified, or anonymized data derived from user activity for purposes such as:
  1. Data analytics and statistical reporting;
  2. Improving game performance, platform stability, and User experience;
  3. Research and development of new features or services;
  4. Detecting User gameplay trends and ensuring operational integrity; and
  5. Identifying, preventing, and mitigating any fraudulent, unlawful or abusive activity on the Platform.
6. Such data will not directly identify any individual user and may be shared with partners or service providers in accordance with the Privacy Policy.
7. For comprehensive details regarding data collection, processing, sharing, retention, and User rights, please refer to the Privacy Policy. Continued use of the Platform constitutes your acknowledgment and acceptance of the practices described therein.
8. PokerBoss does not knowingly collect, store, or process personal information of individuals under the age of 16 (or a higher applicable minimum age in the User’s jurisdiction). Personal information of Users aged 16 years and above but below the legal age of consent in the concerned jurisdiction would be processed in accordance with applicable data protection laws of such jurisdiction and parental consent may be sought, if necessary, in such jurisdiction. Parents and guardians are requested to monitor and prevent Platform usage for underage individuals through device-level parental controls.
Representations and Warranties
You represent and warrant that:
1. You satisfy the eligibility criteria mentioned in these Terms at all times, are eligible to access the Platform Services and compete in the Games offered by the Platform.
2. Any information You provide to Us at any time during the access and use of Our Services, whether at the stage of registration or any time thereafter is correct, complete, up-to-date, and accurate. We shall not be liable against any claim relating to the accuracy, completeness, and correctness of any information You provide to Us. We may, at any time and at Our sole discretion, require You to verify the correctness, completeness, and accuracy of such information, and to that extent require You to produce additional documentary proof. Where You fail to provide Us with valid documentary proof, We reserve the right to limit Your access and use of Our Service.
3. You will protect the information You provide Us, including Your password used to avail of Our Services. We will never require You to enter or disclose Your password, except at the time of logging into Our Platform. You must never share Your Account login information with anyone, including any other User or representative of PokerBoss. You understand and agree that We will not incur any liability for information provided by You to anyone which may result in your Account being exposed or misused by any other person.
4. You have the required legal rights in relation to any content that You may transmit, upload, or otherwise make available on the Platform, and such action of Yours shall not violate the intellectual property rights of a third party.
5. You shall use Your Account solely for the purpose of playing the Games offered through Our Services, and not to commit any unlawful or prohibited activity.
6. You have the experience and the requisite skills required to play Games on the Platform and that You are not aware of any physical or mental condition that would impair Your capability to fully participate in such activity.
7. You are voluntarily choosing to play Games on the Platform and accordingly assume all responsibility and risk resulting from Your participation in any Game or other activity on the Platform. You understand that the Platform shall not be liable for any loss, financial or otherwise, that You may sustain as a result of your use of the Platform.
8. PokerBoss is not responsible for Your inability to access or play any Game, or event in which You may be eligible to participate, irrespective of the cause of such event. This includes situations where You are unable to log into your Account or the same may be pending validation, or You may be in suspected or established violation of any of the Platforms Terms or Policies.
9. You will not attempt to use the Platform in any manner, directly or indirectly, to aid, abet, facilitate, engage or induce other Users to engage in any external exchange, transfer, or misuse of Virtual Items or any Platform Service.
10. You will always remain in strict compliance with all Applicable Laws and abide by all Platform Policies at all times.
Suspension, Termination & Forfeiture
1. Users agree and acknowledge that PokerBoss reserves the right, at its sole discretion and without prior notice, to temporarily suspend, restrict, or disable User access to the Platform or any part thereof, including Virtual Items, during the course of any investigation into suspected misconduct, Prohibited Conduct, fraudulent activity, misuse of Platform/Account, breach/attempted breach of Platform security or privacy protocols, these Terms, other Platform Policies or any Applicable Law, or any action deemed inconsistent, in its sole discretion, with the integrity, security or lawful operation of the Platform; safety and interests of other Users; or interferes with Platform’s compliance of the Applicable Laws, Platform Policies, corporate policies or any applicable code of conduct or best practices.
2. We may, at our sole discretion and without prior notice, permanently terminate or deactivate a User’s Account with immediate effect, including but not limited to where:
  1. The User is found to have violated these Terms, other Platform Policies or any Applicable Law;
  2. Fraudulent, abusive or illegal behaviour or Prohibited Conduct is detected;
  3. Any request, notice, complaint, order, directive, or instruction issued by a government, regulatory, or law-enforcement authority; or
  4. Continued access is deemed to pose a risk to the Platform, other Users, or regulatory compliance of the Platform with Applicable Laws, or in compliance of its internal governance, risk management, and operational policies, including Platform Policies.
3. Consequences of Termination
  1. Upon termination, the User shall not be permitted to access or use the Services of the Platform thereafter. The Platform may prohibit the User from registering with or accessing the Platform or its Services indefinitely.
  2. User’s limited license to access and use the Platform, its Services and associated Virtual Items shall automatically expire, and any accumulated or unused Virtual Items or credits may be forfeited. Promotions, if any, given to such User will also be automatically forfeited.
  3. The Platform reserves the right to seek compensation from the User for any losses or damages incurred as a result of the User’s breach of these Terms or any Platform Policies.
  4. In case of violation of any Applicable Laws or Platform Policies (including these Terms), We may initiate appropriate civil/criminal proceedings or report such violations to the concerned authorities, as deemed necessary.
4. Any provisions of these Terms that, by their nature, are intended to survive termination including but not limited to this clause, Representations and Warranties, Prohibited Conduct and Fair Play, Intellectual Property Rights, Limitation of Liability and Indemnification, Dispute Resolution and Governing Law shall continue to remain in full force and effect notwithstanding such termination.
Warranty Disclaimers
1. The Platform and all related Services, including features, content, and Virtual Items, are provided on an “as is” and “as available” basis, without any warranties or representations of any kind, whether express, implied, or statutory.
2. To the maximum extent permitted under Applicable Laws, PokerBoss expressly disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or uninterrupted availability of the Platform.
3. The Platform makes no warranty and disclaims all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of the Services; (ii) any harm to Users’ computer system or mobile device operating system, loss of data, or other harm that may result from access to or use of the Services or any content; (iii) any errors or omissions on behalf of itself or on behalf of any third parties (without limitation, including with respect to internet connectivity or In-app purchases). PokerBoss does not warrant that the Platform will be error-free, uninterrupted, secure, or free from viruses, defects, or other harmful components, or that any errors or defects will be identified or corrected. Users acknowledge that they access and use the Platform at their own discretion and risk.
4. PokerBoss may, from time to time, perform scheduled or unscheduled maintenance, updates, or system upgrades, which may result in temporary suspension or unavailability of the Platform. PokerBoss shall not be liable for any loss, interruption, or inconvenience caused due to such maintenance or downtime or otherwise.
LIMITATION OF LIABILITY AND INDEMNIFICATION
1. By accessing or using the Platform in any manner, You agree to indemnify, defend, and hold harmless the Platform, Zaptech, its affiliates, subsidiaries, licensors, directors, officers, representatives, employees, consultants, and agents (collectively, “Indemnified Persons”) from and against any and all claims, notices, summons, actions, proceedings, judgements, orders, liabilities, losses, damages, penalties, fines, costs, and expenses (including reasonable legal fees) that the Indemnified Persons may be subjected to, arising from or related to:
  1. Your use or misuse of the Platform;
  2. Violation of any of these Terms, any Platform Policy(ies) or any Applicable Laws;
  3. Any negligent, fraudulent, unlawful, or prohibited act or omission by You including attempt thereof; or
  4. Any infringement or alleged infringement of third-party rights arising from Your actions on or through the Platform.
  You agree and undertake to fully compensate the Indemnified Persons for all losses or damages, including but not limited to loss of reputation, goodwill, business, revenue, or profits, amongst others.
2. To the maximum extent permitted by Applicable Laws, You agree and acknowledge that the Indemnified Persons shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, losses or claims, including but not limited to loss of profits, data, goodwill, business interruption, or other intangible losses, arising out of or in connection with:
  1. Your access to, use of, or inability to use the Platform or its Services;
  2. Any unauthorized access to or alteration of your data or Account;
  3. Any interruption, error, omission, defect, or delay in operation or transmission; or
  4. Any third-party conduct, statements, or content made available through the Platform.

3. In jurisdictions that do not permit exclusion or limitation of certain liabilities, PokerBoss’s total liability, if any, shall be limited to the amount You have paid (if any) for accessing paid features or In-app purchases during the three (3) months immediately preceding the event giving rise to such claim.
4. You acknowledge that You access the Platform at Your own discretion and risk and You are responsible for Your own conduct. Zaptech is not liable in any manner for any loss, damage or claim that You may suffer or be subjected to while accessing or using the Platform or in connection therewith. You hereby release the Indemnified Persons from any and all claims arising out of or relating to your use of the Platform, including participation in Games or events, or receipt of Promotions, rewards or Virtual Items, interactions with other Users, amongst others. This release expressly includes claims for any injuries, accidents, losses, or damages, anticipated or unanticipated, that may occur in connection with or arising out of Your use of the Platform.
Dispute Resolution & Governing Law
1. These Terms, other Platform Policies and any dispute or claim arising out of or in connection with them, shall be governed and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
2. In the event of any disagreement, controversy, or dispute arising from or relating to the interpretation, performance, or enforcement of these Terms or any other Platform Policy (“Dispute”), the parties shall first endeavour to resolve the matter amicably through good faith negotiations. If such Dispute is not resolved within sixty (60) calendar days of receipt of written notice from one party to the other, the matter shall be referred to and finally resolved by arbitration as provided below.
3. Agreement to Arbitrate: All Disputes shall be resolved through final and binding arbitration under the Rules of the London Court of International Arbitration (“LCIA”), by a sole arbitrator appointed in accordance with such Rules. The seat and venue of arbitration shall be London, United Kingdom, and the proceedings shall be conducted in English. The arbitral award shall be final and binding upon both parties and enforceable in any court of competent jurisdiction.
4. To the fullest extent permitted by law, all Disputes must be resolved on an individual basis. You agree that neither you nor PokerBoss shall bring or participate in any class, collective, consolidated, or representative action in connection with any Dispute. The arbitrator may not consolidate more than one User’s claims or otherwise preside over any form of a representative or class proceeding.
5. Notwithstanding the arbitration provisions above, either party may seek temporary, injunctive, or equitable relief from a court of competent jurisdiction to protect its rights, data, or intellectual property pending the outcome of arbitration. Such measures shall not be deemed incompatible with or considered a waiver of the agreement to arbitrate.
6. For Disputes that are excluded from arbitration or where arbitration is deemed unenforceable, jurisdiction shall vest exclusively with the courts of London, United Kingdom.
Force Majeure
1. PokerBoss shall not be held liable for any delay, failure, or interruption in performance or availability of the Platform and its Services arising from any event, circumstances or conditions beyond Our reasonable control, including but not limited to: acts of God, natural disasters, earthquakes, fire, flood, storms, pandemic, epidemics, accidents, war, terrorism, riots, embargoes, civil or military actions, strikes, blockades, labour or material shortages, national emergencies, regulatory changes including change in law or policy, network or infrastructure failures, power outages, internet outages, failure or diminishment of power or telecommunications or data networks or services, etc. or any governmental restrictions or actions (each, a Force Majeure Event).
2. In such circumstances, PokerBoss’s obligations shall be suspended for the duration of the Force Majeure Event causing the delay or failure of Services. Users hereby agree that PokerBoss shall not be liable or required to compensate Users for any losses, damages, or delays arising from or attributable to any Force Majeure Event.

1. PokerBoss may issue notices, updates, or other communications relating to the Platform, these Terms or other Platform Policies via email, in-app notifications, push messages, or postings on the Platform. Such notices shall be deemed to have been received by Users at the time of transmission or posting.

Grievance Redressal Mechanism
1. If You have any complaints, concerns, or grievances relating to:
  1. Any User Content that You believe violates these Terms, including infringement of intellectual property rights, defamation, or offensive material;
  2. Your access to or use of the Platform; or
  3. Any other matter relating to the operation of the Platform,

2. Upon receipt of Your complaint or concern, the Grievance Officer (or designated representative) may contact You to acknowledge receipt, seek additional information or clarification, and verify the authenticity of the complaint. The complaint shall be reviewed and resolved appropriately within a reasonable time in accordance with the Applicable Laws and Zaptech’s policies.
3. The Platform reserves the right to change or replace the Grievance Officer at its discretion. Any such change shall be communicated through publication on the official website or within the Platform, and shall take effect immediately upon publication.
4. You agree that any complaint, claim, or grievance arising out of or relating to the use of the Platform, its content, or any of the Platform Policies shall be submitted within thirty (30) days from the date of the alleged cause of action. Complaints filed after this period may not be considered, except where required by Applicable Laws or under exceptional circumstances.
Assignment, Severability, and Miscellaneous
1. Zaptech may, at its sole discretion, assign, delegate, or transfer these Terms, in whole or in part, including any of its rights or obligations, to any affiliate, subsidiary, or successor entity in connection with a merger, acquisition, corporate reorganization, or transfer of assets, at any time without requiring consent from Users.
2. Users shall not under any circumstance assign, transfer, or sublicense any of their rights or obligations under these Terms without Zaptech’s prior written consent, and any attempt to do so without such consent shall be null and void.
3. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be deemed severed to the extent necessary, and the remaining provisions shall continue in full force and effect.
4. No waiver of any right, power, or remedy under these Terms shall be effective unless made in writing and signed by Zaptech. Any failure or delay by Zaptech in insisting upon strict performance of any of the provisions herein or in exercising any right shall not operate as a waiver thereof, nor shall it preclude any future exercise of that right or remedy.
5. These Terms, together with the Privacy Policy, Clubs & Leagues Agreement, Community Rules, Frequently Asked Questions and any applicable Feature Terms or Promotion Terms (collectively, “Platform Policies”), constitute the entire agreement between you and Zaptech with respect to the subject matter hereof, and supersede all prior or contemporaneous understandings, representations, or agreements, whether written or oral, relating to your use of the Platform.
